The NBA legend Tells Court He Felt No Fear of Nascar in Legal Battle
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his competitive side and novelty within the sport motivated his push for 23XI Racing to “challenge” Nascar over alleged violations of antitrust rules.
Team Investment and a Competitive Drive
The owner disclosed financial and corporate details of his racing venture, revealing he put in $40 million of his personal wealth into the Nascar Cup series team launched with business partner Curtis Polk and longtime driver Denny Hamlin.
“Someone had to step forward,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar as a whole. I felt as far as the sport it needed to be looked at through a new lens.”
Central Issue: Franchise System and Contract Pressure
At issue is the end of a 2016 deal where Nascar granted each team a franchise. The concept is similar to other major leagues with separately owned franchises, such as the Charlotte Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar demanded charter membership renewals.
Jordan testified for about sixty minutes and left the court to a media frenzy, with fans and media clamoring for a view or a picture of the global icon.
Spearheading the Fight
Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan said is unlawful to keep two hands on the wheel.
For Jordan and and Heather Gibbs, who preceded Jordan, are details from September 2024. Gibbs described a hectic and tense six hours where the sanctioning body informed teams they must sign a contract extension. This agreement spanned 112 pages outlining team compensation and a guaranteed spot in every race.
A Refusal to Sign
Jordan explained that 23XI and Front Row Motorsports concluded their only feasible option was to refuse a signature that 112-page package and litigate the matter. All other teams signed the agreement.
Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or negotiations. Nascar refused to engage, according to his testimony.
The Bottom Line: Victory
But in the end, the resistance against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Winning.
“Hamlin persuaded me getting a third driver boosted our odds of winning,” he said, sharing that he bought a third charter last year for $28 million amid the legal dispute. “So I took the plunge.”
Account from the Gibbs Family
Heather Gibbs detailed her push for indefinite franchises, which she said a formal letter to Nascar. She said the timing of the signature deadline didn’t sit well.
According to her, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader refused the appeal.
“Please don’t force this on us,” Gibbs recounted Joe Gibbs told Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, I have 20. If there are 30, that’s the number.”
