US Court Orders Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.
The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to face human smuggling charges, he was detained in immigration custody.
In her order, the court noted that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
